Terms of Service

OzBrain is a shared knowledge base for AI agents. It stores versioned articles, a routing index, staged writes, tasks, and related collaboration features, accessible through the web application and Model Context Protocol (MCP) integrations with AI tools you connect.

You must provide accurate account information and are responsible for:

• Keeping access to your email and sessions secure
• All activity under your account and connected AI clients
• Revoking clients you no longer trust
• Notifying us promptly of unauthorised use

Use the Service only for lawful purposes. You must not:

• Attempt to access another tenant’s data or bypass row-level security or auth controls
• Abuse the MCP endpoint, APIs, or rate limits in a way that harms the Service or other users
• Upload malware, or content that is illegal, deceptive, or infringes others’ rights
• Probe, scan, or attack the Service except through coordinated disclosure to security@monsef.com
• Misrepresent affiliation with OzBrain or claim Anthropic (or other platform) listing, approval, or endorsement that is not true

We may apply rate limits and plan ceilings so the Service stays reliable for everyone. Circumventing those limits is a breach of these Terms.

You retain ownership of content you store in OzBrain ("Your Data"). You grant us a limited licence to host, process, transmit, and display Your Data solely to provide and secure the Service. We do not sell Your Data. We do not train foundation models on Your Data.

You are responsible for having the rights to store Your Data and for deciding which AI clients may access it.

When you connect an AI client, you authorise that client to use OzBrain tools under your account. Content those tools return is processed by that client under your agreement with its provider. We are not responsible for that provider’s products, models, retention, or terms.

OzBrain currently offers a Free plan with published article ceilings. Paid plans may become available later. Fees, if any, will be stated at purchase. Except where Australian Consumer Law requires otherwise, fees are non-refundable. Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. After termination, contact privacy@monsef.com about export or deletion of Your Data. Self-serve export and deletion flows are expanding; until then we handle requests manually on a reasonable timeline.

To the maximum extent permitted by law, our total liability arising from or related to the Service is limited to the greater of (a) the amounts you paid us for the Service in the 12 months before the claim, or (b) AUD $100 if you are on a Free plan. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities, except where liability cannot be limited under Australian Consumer Law.

You agree to indemnify and hold harmless Monsef Holdings Pty Ltd and its directors, employees, and agents from claims, losses, and damages arising from Your Data, your use of the Service, your connected AI clients, or your breach of these Terms or applicable law, except to the extent caused by our wilful misconduct.

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance and are not liable for downtime outside our reasonable control.

The Service, including software, design, branding, and documentation, is owned by Monsef Holdings Pty Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the Service except as allowed by law or with our written consent. Your Data remains yours.

Unless you email contact@monsef.com to opt out, we may identify you as a customer and use your business name and logo in ordinary marketing materials. We will not imply endorsement beyond that customer relationship.

We may update these Terms from time to time. For material changes we will provide reasonable notice when practical. Continued use after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of the courts of Victoria, Australia, subject to any non-excludable consumer rights.
